The National Autonomous University of Mexico seeks due process in the Yasmín Esquivel case

In Latin America in recent weeks, a case has drawn attention about the duplication of a thesis at the National Autonomous University of Mexico (UNAM), which is considered the most important Spanish-speaking public university in the region.

Enrique Graue Wiechers, President of the UNAM, reported that the case of Yasmín Esquivel Mossa, minister of the SCJN, will continue to be analyzed due to the new evidence for her that has emerged in recent days on the thesis called “Ineffectiveness of the unions in the workers of Article 123 of the Constitution, section A”.

This case had a radical change, due to the information that a media outlet in Mexico released last Thursday, January 19th, which shows images of the evidence of facts made by the notary public 121 of Mexico City, in which the other student Édgar Ulises Báez is observed signing the document at home in which he assures that he took several important parts of the work, texts and references developed by the minister of the SCJN, Esquivel Mossa. He had denied it in an interview given on December 31st to a news portal, but after the videos and photographs were published, the same site has publicly acknowledged that the lawyer lied to them.

Yasmín Esquivel Mossa assures that she is the original author of the thesis “Ineffectiveness of the unions in the workers of Constitutional Article 123, section A”. In her official statement on December 30th, she stated that she is the original author of said project since 1985, and that she has submitted scientific and technical evidence to the formal channels of relevant institutions. While her detractors have based their criticism of her on the date of publication.

The media has made known the existence and registration of a capitulation dated December 1985 in the name of Esquivel Mossa, in addition to having the expert opinion in document copying and computer science, which proves that she did begin the work previously but it could not be titled because she worked in the Coyoacán delegation and her social service had not yet been released.

Another relevant fact is that it was made public that Professor Martha Rodríguez Ortíz, adviser to both lawyers, acknowledged in a statement before the UNAM authorities that she gave, just to be taken as a reference, Báez Gutiérrez as well as others students the Esquivel Mossa thesis project that had begun in December 1985 and concluded in April 1986, according to existing records and expert opinions. It is also for this fact that the university decided to dismiss her from it.

The UNAM reported that its Ethics Committee seeks to carry out a due process to which everyone is entitled and to analyze the evidence that continues to emerge, as well as the documentation gathered by the FES Aragón, directed by Fernando Macedo Chagolla. Although initially, they gave an opinion without calling the parties, it is now that the originality of the minister’s evidence has been verified, that they will analyze the case in depth again to know who started the thesis and not just based on the date of publication. 

For its part, the Faculty of Law, directed by Raúl Juan Contreras Bustamante, has called for university unity. Alfredo Sánchez Castañeda, the general lawyer, at the time has reported that the title cannot be removed for those who are found to have committed plagiarism almost 40 years ago.
